Sample Language of a Bequest

  1. Unrestricted Bequest: "I give, devise, and bequeath to the Fredonia College Foundation, the sum of _____ dollars ($ ) for [state purpose (e.g. its general purposes, for scholarships, for library acquisitions)]”

  2. Amount of Gift Dependent on the Size of the Estate: "I give, devise, and bequeath to the Fredonia College Foundation, the sum of _____ dollars ($ ), or _____ percent of my adjusted gross estate as finally determined for federal estate tax purposes, whichever is the lesser, for [state purpose (e.g. its general purposes, for scholarships, for library acquisitions)]."

  3. Endowment Bequest (minimum of $10,000): "I give, devise, and bequeath to the Fredonia College Foundation, the sum of _____ dollars ($ ), to establish an endowment, with the net income therefrom to be used for [state purpose (e.g. its general purposes, for scholarships, for library acquisitions)]. If, in the future, circumstances have so altered that it is no longer feasible, in the opinion of the Executive Board of the Fredonia College Foundation, to continue the terms of this agreement, said Board shall be required to apply this fund to such purposes as may, in its opinion, most closely fulfill the intentions of the donors herein described."

  4. A Specific Legacy: "I give, devise, and bequeath to the Fredonia College Foundation, my [e.g. art collection consisting of paintings and sculptures, real property located at _____ , book collection consisting of _____ ]."

  5. Gift of Residuary Estate: "I give, devise, and bequeath to the Fredonia College Foundation the residue of the property owned by me at my death, real and personal and whatever situate, for [state purpose (e.g. its general purposes, for scholarships, for library acquisitions)].”

  6. Contingent Gift of Residuary Estate: "I give, devise, and bequeath the residue of the property owned by me at my death, real and personal and whatever situate, to my wife, [state name] , if she survives me. If my wife does not survive me, I give, devise, and bequeath my residuary estate to the Fredonia College Foundation, for [state purpose (e.g. its general purposes, for scholarships, for library acquisitions)]."
